Supreme Court held that two first information reports for the same incident could be registered by police.SC said it was for the cops to find out whether the second FIR related to the same incident or events. "If the answer is in the affirmative, the second FIR is liable to be quashed. However, in case the contrary is proved, where the version of the second first information report is different and they are in respect of two different incidents/ crimes, the second first information report is permissible," the bench said. The ruling is likely to put police authorities, often reluctant to register FIRs in the first place, in a fix and also raise the question about an accused manipulating such an option. |
